Going through divorce can be an emotionally and legally difficult process. There are many factors to take into account, and if you and your spouse are unable to make decisions together, it can further add to the stress of the situation. Since 1999, our Mesa divorce attorney has been working with clients to ease the burden during a difficult time and aggressively seek a legal solution. We look out for the best interests of our client, are licensed to practice at many levels, including the U.S. The Supreme Court, and knowledgeable of all areas of family law in Arizona.
Contested & Uncontested Divorce
Important issues that will be decided in any divorce include parenting time, spousal support, child support, and the division of assets and debts. Agreements can be made together or with the help of a judge, particularly when the two parties involved do not agree on decisions being made. This is referred to as a contested divorce case and is often a much more difficult process. Being well-represented by an aggressive attorney who understands how to get the job done right and protect your best interests is vital.
Whatever the specifics, the divorce process in Arizona includes:
- A Petitioner files documents, including the Petition for Dissolution of Marriage
- The documents are then served to the Respondent
- A Respondent has 20 days to file a Response if they disagree with the terms
- If no response is filed, the Petitioner will file an Application for Entry of Default
- The Respondent has 10 days to file their Response
- After this the Petitioner can move forward with setting the hearing
- During discovery each side has access to information from the other party
- In many cases a settlement can be reached between both sides
- If a settlement is not reached, the case can go to trial where a judge makes the ruling
